Eligibility
By using Artaway, you represent that you are at least 18 years old or the legal age of majority in your jurisdiction. If you are under 18, you may not use this platform without parental or guardian consent.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and password. You agree to notify us immediately of any unauthorized access or use of your account. Artaway is not liable for any loss or damage arising from your failure to protect your account.
Content and Intellectual Property
You retain all rights to your art, photographs, and other creative content you upload to Artaway. By uploading content, you grant Artaway a non-exclusive, royalty-free license to display and distribute your content on the platform, in marketing materials, and in our guides or resources, with appropriate credit to you. You represent that you own or have the right to share all content you post and that it does not violate any third-party rights or laws.
Acceptable Use
You agree not to use Artaway for harassment, discrimination, fraud, spam, or any illegal activity. You must not impersonate others, post false information, or attempt to manipulate the platform or other users. Violations of this policy may result in account suspension or termination at Artaway's sole discretion.
Reviews
Reviews must be truthful, based on genuine experiences, and written in good faith. You may not post defamatory, misleading, or fabricated content in reviews. Reviews are permanent — once submitted, they cannot be edited or deleted by the author. This policy exists to maintain the integrity and trustworthiness of the review system. Hosts may post a single public response to each review, which is also permanent. Artaway reserves the right to remove reviews that violate these terms.
Messaging
Messages sent through Artaway are stored on our servers to facilitate communication between artists and hosts. You agree not to use the messaging system for spam, unsolicited commercial messages, or any form of harassment. Messages should be relevant to potential exchanges, residencies, or collaborations on the platform.
Applications
When an artist applies to a listing, both the artist and the host can view the application message. Hosts may accept, decline, or mark applications as completed. Application messages and status history are retained as part of the platform record.
Emails and Notifications
By creating an account, you agree to receive transactional emails related to your activity on the platform, including application updates, new messages, review notifications, and account-related notices. These emails are sent through our email service provider, Brevo. You can manage your notification preferences in your dashboard settings, but certain essential account emails (such as password resets and security alerts) cannot be disabled.
Account Deletion
You may delete your account at any time through your dashboard settings. When you delete your account, your profile, listings, messages, and applications are removed. However, reviews you have written may be anonymized and retained to preserve the integrity of the review system for other users.
Platform, Not Party
Artaway is a platform that facilitates connections between artists and hosts. We are not a party to any exchange, residency, gig, or agreement made between users. Users are solely responsible for negotiating terms, making payments, and fulfilling their obligations to one another. Artaway does not mediate disputes, guarantee the quality of exchanges, or provide insurance or liability coverage for user interactions.
Limitation of Liability
Artaway is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service or the accuracy of user-generated content. To the fullest extent permitted by law, Artaway and its creators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.
Termination
Artaway may suspend or terminate your account at any time, with or without notice, if you violate these Terms of Service or engage in conduct we deem harmful to the platform or other users.
Governing Law
These Terms of Service are governed by the laws of the jurisdiction in which Artaway operates. Any disputes shall be resolved in the courts of that jurisdiction.
